Ongoing representation of RBS Financial Products Inc. in putative nationwide borrower class action alleging, among other things, violations of the Truth in Lending Act (TILA) in RBS's subsequent purchase of payment option adjustable rate (Option ARM)mortgage loans from originator. Successfully achieved dismissal of multiple causes of action, including of plaintiffs' TILA claim, on motion to dismiss. Motion for summary judgment filed by RBS as to remaining claims, and plaintiffs'motion for class certification, which RBS has opposed, are scheduled for hearing in August 2011.
