AmBanker on BuckleySandler Win Against FDIC
American Banker, in an article by Joe Adler, covers a recent ruling by the United States District Court in favor of BuckleySandler client Advanta Bank that the FDIC's authority "is not limitless and does not allow for the contravention of the law which gave that agency its authority."
The article quotes Andrew Sandler, Co-Chair of Buckley Sandler and Advanta's attorney, as saying "This decision is a welcome reminder from the federal judiciary that the FDIC and other bank regulators must be careful to stay within their authority in exercising their extraordinary powers to address the current financial crisis."
