Many of the bureau’s enforcement actions include guidance that shows firms what the CFPB expects in the wake of the consent agreement it has reached.
Given that the CFPB’s director, Richard Cordray, is a former Ohio attorney general and the high positions held by others with enforcement backgrounds at the bureau, that is not a surprise.
"The composition of the senior team at the CFPB is more enforcement-oriented than prudential regulation-oriented, and that probably explains it in part,” said Andrew Sandler, the chairman and managing partner at BuckleySandler LLP. “It’s also explained by the bureau’s perceived need to have a significant impact early, and that’s easier achieved through enforcement than through traditional prudential regulation.”
