The unprecedented criminal charges brought by the U.S. Department of Justice against supplement companies including USPlabs LLC reveals allegedly damning exchanges between top company executives about wanting to avoid landing "on the FDA radar," which attorneys say can provide compelling evidence for plaintiffs attorneys to bring their own consumer fraud claims over their popular weight loss and workout supplements.
The unprecedented federal actions signal that agencies are responding to calls from consumer groups and state prosecutors to ramp up their oversight of the industry, according to Douglas Gansler of BuckleySandler LLP, a former Attorney General of Maryland.
"2015 marks the turning point in the industry in terms of regulation," he said. "The state AGs, and now the DOJ, have sent up a very clear signal that they're really going to be looking behind the labels of these supplements."
