Lawyers in BuckleySandler’s E-Commerce Practice Group are at the forefront of legal, regulatory and related standards-setting matters germane to electronic commerce. We advise clients on the design, development and implementation of business plans and related systems, as well as financial products and services offered and delivered by electronic means. We are also heavily engaged in related transactional matters.
Attorneys in our E-Commerce Practice Group have broad backgrounds and experience in payment systems, privacy and data security, electronic financial services, electronic signatures and records, and mobile commerce. In an environment of change and uncertainty, we are able to apply that experience to all aspects of consumer finance laws and regulations governing business conducted over the Internet and through mobile devices.
Recent projects in which the Practice Group has been involved include:
- Advising on a joint venture to create a national mobile commerce system that will fundamentally transform how people shop, pay and save.
- Assisting an automotive finance company structure a system for the creation, storage, and transfer of electronic chattel paper.
- Assisting a large data processor develop its record retention and conversion policies.
- Assisting a major insurance company comply with state and federal online data privacy/security laws and laws on unsolicited commercial email.
- Advocating on behalf of a coalition of clients for the uniform adoption of the electronic record and signatures laws in California, Massachusetts, and Iowa.
- Assisting technology vendors structure systems for delivering federal and state disclosures to consumers.
- Advising on the use of voice recognition technology in financial services transactions.
- Advising on the impact of the Electronic Signatures in Global and National Commerce (ESIGN) Act on Regulation E and the rules of the National Automated Clearing House Association (NACHA).
- Serving as Counsel and Reporter to Standards and Procedures for Electronic Records and Signatures (SPeRS).
- Serving as Counsel to the Electronic Financial Services Council and the Electronic Records and Signatures Association.
- Reviewing state electronic signature and record laws and their impact on the mortgage transaction.
- Participation in the Mortgage Industry Standards Maintenance Organization (MISMO).
