Biography

Andrea Mitchell, a partner in the Washington, DC office of BuckleySandler LLP, focuses her practice on fair and responsible banking matters. She advises financial services companies throughout the country in administrative enforcement and regulatory compliance matters involving fair lending, disparate impact, UDAAP, and other unfair, predatory, or anti-discrimination statutes and regulations. Ms. Mitchell represents clients in federal and state enforcement agency examinations and investigations, congressional investigations, and corporate internal investigations. Specifically, she has represented clients in examinations and investigations by the:

  • Department of Justice
  • Consumer Financial Protection Bureau
  • Federal Reserve Board
  • Office of the Comptroller of the Currency
  • Federal Deposit Insurance Corporation
  • Federal Trade Commission
  • Department of Housing and Urban Development
  • State attorneys general

Ms. Mitchell also has extensive experience in counseling financial institutions on regulatory compliance and risk management with respect to Equal Credit Opportunity Act, Fair Housing Act, Truth in Lending Act, Truth in Savings Act, and UDAAP laws. 

Given recent areas of fair lending, fair servicing and UDAAP focus by the CFPB and the prudential regulators, Ms. Mitchell is actively advising her financial services clients on matters involving compliance and risk management including:

  • Steering
  • Redlining
  • Product development
  • Ancillary products
  • Sales and marketing
  • Servicing, collections and loss mitigation activities
  • Vendor management
  • Claims fulfillment

Ms. Mitchell is a frequent speaker at conferences and seminars on fair lending and UDAAP topics and was a contributor to the American Bankers Association’s Fair Lending Toolbox released in 2012.  She also conducts in-house training and continuing legal education seminars on a variety of consumer compliance topics.

Prior to joining BuckleySandler, Ms. Mitchell served as a counsel in the Legal Division at the Federal Reserve Board. While there, she worked on numerous consumer regulations supervised entities on queries related to consumer protection statutes and participated in several interagency task forces.

Ms. Mitchell was a litigation associate at Skadden, Arps, Slate, Meagher & Flom LLP before working at the Federal Reserve Board, and she served as a law clerk to the Honorable Mary Ellen Barbera of the Maryland Court of Special Appeals. She received her J.D. from American University (summa cum laude) in 2002 and her B.A. from the  University of Wisconsin-Madison in 1993.
