Biography

Valerie L. Hletko is a partner with BuckleySandler LLP. Ms. Hletko represents institutions and individual clients in complex civil litigation and class actions. She also represents clients in connection with regulatory examinations, investigations, and administrative enforcement actions initiated by the United States Department of Justice (DOJ), the Federal Deposit Insurance Corporation (FDIC), the Federal Reserve Board (FRB), the Consumer Financial Protection Bureau (CFPB), the Department of Housing and Urban Development (HUD), and state bank regulatory agencies and state Attorneys General.

Ms. Hletko counsels clients on risk management, fair lending, loss mitigation and residential mortgage loan modification programs, and compliance with consumer financial laws, such as the Fair Credit Reporting Act (FCRA), the Equal Credit Opportunity Act (ECOA), the Home Mortgage Disclosure Act (HMDA), the Fair Debt Collections Practices Act (FDCPA), the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), and prohibitions on unfair, deceptive, or abusive practices in Section 5 of the Federal Trade Commission Act (UDAP) and Section 1036 of the Consumer Financial Protection Act (UDAAP).  

Ms. Hletko’s recent representations include:

  • Oversaw one of the very first compliance examinations of a non-bank mortgage lender by the CFPB.
  • Handling a considerable number of pre-enforcement and enforcement matters, including managing self-disclosure and drafting responses to PARR (Proposed Action and Request for Response) and 2(b) Letters relating to CARD Act compliance, compliance management, debt collection, overdraft coverage and related services, ancillary products, and vendor management;
  • Representing banks and non-banks in CFPB examinations and investigations relating to mortgage origination and servicing, payment cards, ancillary products, and specialty finance (short-term, small-dollar, and other unsecured consumer loans);
  • Representing clients in investigations and enforcement actions brought by state Attorneys General and by the CFPB;
  • Assisting financial services companies with regulatory examination readiness reviews, including mock examinations relating to vendor management and mortgage servicing;
  • Representing banks in lawsuits filed by county and city governments under the Fair Housing Act seeking damages stemming from the foreclosure crisis;
  • Representing banks in borrower litigation relating to foreclosure proceedings; and
  • Performing gap analyses and acquisition due diligence relating to credit card rewards, mortgage lending, mortgage servicing, and specialty finance.

Ms. Hletko lectures and publishes on a range of subjects of interest to financial institutions, including fair and responsible banking practices, specialty finance, vendor management, and regulatory enforcement trends.

She is active in the American Bar Association, where she is Chair of the Retail Banking and Consumer Law Subcommittee of the Banking Law Committee.  She serves on the Out in Law Leadership Committee and as a Trustee for the Washington Lawyers’ Committee for Civil Rights and Urban Affairs. She is recognized as a Super Lawyer in Consumer Law, Civil Litigation, and Banking.

Prior to joining BuckleySandler LLP at its inception in 2009, Ms. Hletko was an associate attorney with Skadden, Arps, Slate, Meagher & Flom LLP and with Paul, Weiss, Rifkind, Wharton & Garrison LLP.  She holds a J.D. from The University of Chicago, an M.T.S. from Harvard University, and a B.A. from Kenyon College.
