Biography

Valerie L. Hletko is a partner with BuckleySandler LLP.  She represents financial institutions and other financial services industry participants in examinations, investigations, and administrative enforcement actions initiated by the United States Department of Justice (DOJ), the Federal Deposit Insurance Corporation (FDIC), the Federal Reserve Board (FRB), the Consumer Financial Protection Bureau (CFPB), the Department of Housing and Urban Development (HUD), and state bank regulatory agencies and state Attorneys General.

Ms. Hletko’s substantial enforcement practice is focused on a broad range of consumer finance issues, including fair and responsible lending and prohibitions on unfair, deceptive, or abusive practices in Section 5 of the Federal Trade Commission Act (UDAP) and Section 1036 of the Consumer Financial Protection Act (UDAAP).  She also has extensive experience handling government examinations and investigations, including one of the very first compliance examinations of a non-bank mortgage lender by the CFPB.

Ms. Hletko also has experience representing financial institutions in individual and private class action litigation alleging violations of federal and state fair lending laws, mortgage fraud, and laws governing financial products trade practices.

Ms. Hletko counsels financial institutions on risk management, loss mitigation and residential mortgage loan modification programs, and compliance with consumer protection laws, such as the Fair Credit Reporting Act (FCRA), the Equal Credit Opportunity Act (ECOA), the Home Mortgage Disclosure Act (HMDA), the Fair Debt Collections Practices Act (FDCPA), the Real Estate Settlement Procedures Act (RESPA), and the Truth in Lending Act (TILA).

Ms. Hletko’s recent representations include:

  • Handling a considerable number of pre-enforcement and enforcement matters, including managing self-disclosure and designing and drafting responses to PARR (Proposed Action and Request for Response) and 2(b) Letters relating to CARD Act compliance, compliance management, debt collection, overdraft coverage and related services, ancillary products, and vendor management;
  • Representing banks and non-banks in CFPB examinations, investigations, and enforcement actions relating to mortgage origination and servicing, payment cards, ancillary products, and specialty finance (short-term, small-dollar, and other unsecured consumer loans);
  • Assisting banks and non-banks with CFPB examination readiness reviews, including mock examinations relating to vendor management and mortgage lending and servicing;
  • Representing banks in lawsuits filed by county and city governments under the Fair Housing Act seeking damages stemming from the foreclosure crisis;
  • Representing banks and non-banks in investigations and enforcement actions brought by state Attorneys General in connection with consumer protection and consumer financial laws;
  • Representing banks in borrower litigation relating to foreclosure proceedings; and
  • Performing gap analyses and acquisition due diligence of mortgage lenders and specialty finance companies.

Ms. Hletko lectures and publishes on subjects of interest to financial institutions, including fair and responsible banking practices, specialty finance, and regulatory enforcement trends.

Ms. Hletko is active in the American Bar Association, where she is Chair of the Retail Banking and Consumer Law Subcommittee of the Banking Law Committee.  She serves on the Out in Law Leadership Committee and as a Trustee for the Washington Lawyers’ Committee for Civil Rights and Urban Affairs. She is recognized as a Super Lawyer in Consumer Law, Civil Litigation, and Banking.

Prior to joining BuckleySandler LLP at its inception in 2009, Ms. Hletko was an associate attorney with Skadden, Arps, Slate, Meagher & Flom LLP. From 2001-2003, she was an associate with Paul, Weiss, Rifkind, Wharton & Garrison LLP.  She holds a J.D. from The University of Chicago, an M.T.S. from Harvard University, and a B.A. from Kenyon College.
